When I unexpectedly received a letter from a lawyer (with authorization of over 10 major movie lables) on the 14th Octobre 2005 I was truly shocked. I was told to stop the service immediately and to pay 10.000 Euro (+1.171,08 Euro lawyer bills), the alternative being a trial at court which could've ended in a two years sentence in prison and/or 100.000 Euro or more. Consulting my own lawyer, I was advised to give in and take down the site, then negotiate with them. Finally on the 8th Novembre 2005 we reached an agreement. I had to pay 6.171,08 Euro and sign to never do such a thing again (at least for 30 years).

Well, this was the end of The Freeworld ... at least for a while. Of course I wasn't the only one who had access to the database and page sourcecode. That's when TV Underground was born :)

One of the greatest snes RPG... Wonderful soundtrack too.

About the story, it's quite interesting, but there's something I don't get: how comes that you were prosecuted, when the server was in Russia? This was not under the US federal law...

First off, that's a quote and not posted here by him. Second, he got charged by the GVU which has authority in Austria and Germany....so has nothing to do with the US.

And just cause the server was somewhere else doesn't mean the act itself is legal in a given country. Take the dreaded net cancer known as child porn (as an extreme example)....just cause you host it in some backwards country doesn't mean your country won't get you for it.

He just had the bad circumstance of being identified and where they could get him.

Also me and Che retained the TFW server....the GVU were only able to seize control of the domain.

Also the charges were most likely brought in, because before TFW was moved to my Russian server, it was hosted in Germany

Well, the problem is, that nobody ever tried to really go through a trial. So the case is quite uncertain....

They said that it didn't depend on where it was hosted but on the country I live in... so as an Austrian I am facing Austrian law when comitting a crime. In some way one might argue, that the crime was comitted on the server (which then was in Russia and therefore would require russian law) but still it is a case you'll first have to fight.... and trials cost money... and they have a bit more than anyone of us...

ah.. back to memory lane I am... :)
Miss all those greats times.  I am glad that the tradition continued both here and a couple of other places.  I miss TV4ed2k also, but the main thing is that there has been continuity :)

To TRW and TFW, my glass on hi for you :)  wow... I still miss TRW big time...
